In Wisconsin, a licensee who provides brokerage services works for a party as that party's agent, but Wisconsin law also imposes statutory duties of honesty, fairness, and disclosure that a licensee owes to all parties to a transaction, not just the client. Licensees must provide the required agency/disclosure information at the outset of the relationship, and a firm may represent both buyer and seller as a disclosed multiple representation only with the informed, written consent of the parties. Because Wisconsin is a marital (community) property state, licensees should account for both spouses' interests when title and signatures are involved.
