📖 What you need to know

Massachusetts recognizes several agency relationships, including seller's agent, buyer's agent, dual agent, and designated agent, as well as a non-agent facilitator role where the licensee assists parties without representing either one. A licensee owes fiduciary duties such as loyalty, confidentiality, and full disclosure to the party they represent. Dual agency and designated agency are permitted only with the informed written consent of the clients involved, since they limit the undivided loyalty a licensee can provide.
