• Florida presumes the transaction broker relationship unless another relationship is established in writing.
• Transaction broker: provides limited representation to a buyer, seller, or both without being a fiduciary to either.
• Single agent: owes full fiduciary duties (loyalty, confidentiality, obedience, full disclosure, accounting, skill/care) to one party.
• No brokerage relationship: licensee deals with a party but represents neither side.
• A single agent may transition to transaction broker only with the proper written consent disclosure.
• Florida abolished implied/automatic statutory agency disclosure for many residential transactions in favor of these defined relationships.
• Dual agency (representing both parties as a full agent) is not permitted in Florida.
