Disclosures Oregon Sellers and Licensees Must Make

Oregon · State License Law — free study notes for the real estate licensing exam.

🏛️ State License Law 📍 Oregon

📖 What you need to know

Sellers of residential property in Oregon must generally provide buyers with a Seller's Property Disclosure Statement describing the known condition of the home, its systems, and any material defects. Buyers have a statutory right to revoke the offer within a set period after receiving the statement if disclosures reveal problems. Licensees must disclose material facts they know about a property and cannot misrepresent or conceal them, and federal lead-based-paint disclosure applies to pre-1978 homes. Oregon is not a community property state, so marital-property ownership is determined by title and contract rather than by community property rules.
